Terms of Service

1. Acceptance of Terms
By accessing or using the Layera service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Layera provides an AI-powered image-to-design-file conversion service. Users upload images and receive editable design files. The Service operates on a credit-based system where each conversion consumes a fixed number of credits.
3. User Accounts
To use the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 13 years old to create an account.
4. Credits & Payments
Credits are purchased as one-time transactions and do not expire. All payments are processed by Creem, our Merchant of Record. Pricing and credit amounts are displayed on our pricing page at the time of purchase. Creem handles payment processing, invoicing, and applicable taxes.
5. User-Uploaded Content
You are solely responsible for the content you upload to the Service. By uploading images, you represent and warrant that:
- You own the rights to the images or have obtained all necessary permissions
- The images do not violate any applicable laws or third-party rights
- The images do not contain unlawful, defamatory, or otherwise objectionable content
6. Intellectual Property
You retain ownership of all images you upload to the Service. By using the Service, you grant Layera a limited license to process your images for the purpose of providing the Service. The design files generated from your images are provided to you for your use.
7. Acceptable Use
You agree not to use the Service to:
- Upload content that is illegal, harmful, threatening, or abusive
- Violate any intellectual property rights of others
- Attempt to gain unauthorized access to our systems
- Use the Service in any way that could damage or impair its operation
- Resell or redistribute credits without authorization
8. Indemnification
You agree to indemnify and hold harmless Layera and its operators from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service or your uploaded content, including claims that your content infringes third-party rights.
9. Service Availability
We strive to provide reliable Service but do not guarantee 100% uptime or uninterrupted access. We may modify, suspend, or discontinue the Service at any time without prior notice.
10. Limitation of Liability
To the maximum extent permitted by law, Layera and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for credits in the 30 days preceding the claim.
11. Termination
We may terminate or suspend your account at our sole discretion if you violate these Terms. Upon termination, any unused credits may be forfeited. You may delete your account at any time by contacting us.
12. Dispute Resolution
If you have a dispute, you agree to first contact us at support@layera.pro and attempt to resolve the matter informally through good-faith negotiation before pursuing any legal proceedings.
13. Governing Law
These Terms are governed by and construed in accordance with applicable laws. Any legal actions or proceedings shall be resolved in a court of competent jurisdiction.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
